What is a Ghost Consultant?

Large numbers of consultants operate under the radar, sometimes going to great lengths to dupe the system – or clients – and making loads of money. There is no regulatory body watching over these scrupulous agents and nor are they afraid of any regulatory action. In India, this problem is highly prevalent and clients are duped on a daily basis.

The issue of non-lawyer immigration practitioners is a longstanding problem in Canada, with a significant impact on the integrity of Canada’s immigration system. The incompetent or fraudulent representation of applicants for permanent residence by unscrupulous consultants has been the subject of scrutiny by the federal government since as early as 1981.

For over 20 years, the CBA (Canadian Bar Association) Section has recommended that representation or advice for consideration in section 91 of the Immigration and Refugee Protection Act (IRPA) and its predecessors should be limited to lawyers (who are effectively regulated) or consultants (only if they are effectively regulated). Despite the introduction of two consecutive self-regulating bodies, there is mounting evidence that the regulation of immigration consultants remains inadequate.

On the federal government’s website, in no fewer than 21 languages ranging from Arabic to Vietnamese, people looking to immigrate to Canada are warned to be on the lookout for fraud and to stay away from unauthorized consultants.Don’t be the victim of a scam, the site warns and don’t be tempted into using false documents.

Despite the government’s efforts to regulate the industry, however, large numbers of unlicensed consultants continue to operate under the radar, sometimes going to great lengths to dupe the system – or their clients – and making loads of money doing it.
Many are operating outside these rules. Some of them tout “special connections” with government officials and promise prospective clients guaranteed visas or work permits when they know they can’t deliver.
